Eminem’s bully pounded from court

The bully Eminem wrote about in his song “Drain Damage” (I listen to it every day) has been told he can’t sue for false light.

The appeals court ruled that the song, which said Deangelo Bailey beat up Marshal Mathers III (Eminiem in a bathroom and knocked his head against a urinal, would not be taken seriously because it describes Mathers’ brain falling out and other unbelievable events.

The decision upholds the trial court decision. At trial, Circuit Judge Deborah Servitto wrote:

“The lyrics are stories no one would take as fact
They’re an exaggeration of a childish act
It is therefore this Court’s ultimate position
That Eminem is entitled to summary disposition.”
