This appears to be a different interpretation of Tinker than I have seen anywhere. Essentially it seems to say that if Mary Beth Tinker had been threatened by students who supported the war in Vietnam, the school could have forced her not to wear the armbands. It strikes me as a significant retreat from Tinker.
